Terms and Conditions
1. Introduction and Acceptance
These Terms and Conditions ("Terms") govern your use of the services provided by Expatico Travels and Tours Ltd ("Expatico," "we," "us," "our"), a company duly incorporated in Nigeria, including flight bookings, hotel reservations, tour packages, visa facilitation, and related travel services. Expatico does not operate an online booking portal; bookings are arranged directly through email, phone calls, and social/messaging platforms such as WhatsApp and Instagram. By requesting or confirming any booking with us through these channels, you agree to be bound by these Terms.
2. Our Role as a Travel Intermediary
Expatico acts as an agent/intermediary connecting customers with third-party travel suppliers — airlines, hotels, tour operators, ground transport providers, and visa processing centres. Except where a service is directly and clearly provided by Expatico (e.g., a self-organized tour package), the underlying supplier's own terms, conditions, and liability limits apply to your booking, in addition to these Terms.
3. Booking and Payment
- All bookings are subject to availability and confirmation, and are treated as confirmed once we send written confirmation via email or WhatsApp, regardless of the channel used to initiate the request (phone, WhatsApp, Instagram, or email).
- Full or partial payment (as specified at time of booking) is required to confirm a reservation.
- Prices quoted are subject to change until full payment is received and the booking is ticketed/confirmed, due to factors such as airline fare fluctuations, exchange rate movements, and supplier price changes.
- Payments are processed through our licensed payment partners. You are responsible for ensuring payment details provided are accurate.
- It is your responsibility to verify all names, dates, and travel details exactly as they appear on your passport/ID before payment, as corrections after ticketing may attract fees or be impossible depending on airline policy.
- Instructions or requests given verbally (e.g., by phone call) should be confirmed in writing (email or WhatsApp message) to avoid disputes over booking details.
4. Cancellations, Changes, and Refunds
Cancellations, date changes, and refunds are governed by our separate Refund Policy, and by the specific rules of the airline, hotel, or supplier involved in your booking. Expatico service fees for changes and cancellations are separate from, and in addition to, any supplier-imposed fees.
5. Travel Documentation and Visa Responsibility
- You are solely responsible for ensuring you hold a valid passport, visa, and any other travel documentation required for your journey.
- Where Expatico assists with visa facilitation, this is a best-efforts service. Expatico does not guarantee visa approval, as this decision rests entirely with the relevant embassy or consulate.
- Expatico is not liable for denied boarding, denied entry, deportation, or other consequences resulting from inadequate or invalid travel documentation.
6. Health, Safety, and Travel Advisories
- You are responsible for reviewing and complying with health requirements (vaccinations, insurance, etc.) and government travel advisories for your destination.
- Expatico recommends all travelers obtain adequate travel insurance covering medical emergencies, trip cancellation, and lost baggage.
7. Limitation of Liability
- Expatico's liability is limited to the direct value of the booking fee paid to us for the specific service in question.
- Expatico is not liable for acts, errors, omissions, delays, cancellations, or negligence of third-party suppliers (airlines, hotels, tour operators, visa centres), which are governed by the supplier's own terms and applicable international conventions (e.g., the Montreal Convention for air travel).
- Expatico is not liable for losses arising from force majeure events, including but not limited to natural disasters, pandemics, civil unrest, strikes, or government action.
- Nothing in these Terms limits liability for fraud or gross negligence to the extent such limitation is not permitted under Nigerian law.
8. Customer Conduct
You agree to provide accurate information at the time of booking and to use our services lawfully. Expatico reserves the right to decline service or cancel a booking where fraudulent, abusive, or unlawful conduct is identified.
9. Intellectual Property
All content shared by Expatico, including logos, text, images, and designs across our social media pages, WhatsApp communications, and any promotional materials, is the property of Expatico Travels and Tours Ltd and may not be reproduced without written permission.
10. Data Privacy
Your personal data is handled in accordance with our Privacy Policy, in compliance with the Nigeria Data Protection Act (NDPA) 2023.
11. Dispute Resolution and Governing Law
- These Terms are governed by the laws of the Federal Republic of Nigeria.
- In the event of a dispute, both parties agree to first attempt resolution through good-faith negotiation.
- Where negotiation fails, disputes shall be referred to arbitration in Lagos, Nigeria, in accordance with the Arbitration and Mediation Act 2023, or to the competent courts of Lagos State, at Expatico's election.
12. Amendments
Expatico reserves the right to amend these Terms at any time. Updated Terms will be communicated via email, WhatsApp, or our official social media channels, with a revised "Last Updated" date. Continued use of our services after changes constitutes acceptance of the revised Terms.
